A Study On The Role Of Village Rules And Regulations In Rural Governance

As a policy of "long-term peace and stability",traditional village rules and regulations were used to adjust various relations in the same village.In the long feudal society,they were advocated by the rulers of the past dynasties and were used to stabilize the village order,from the First Written Township Covenant in Chinese History to the movement of "local autonomy" and "rural construction" in the late Qing Dynasty and early Ming Dynasty,the traditional village rules and regulations have been developing and perfecting with the changes of the Times,in the vast rural society of our country,it plays an important role that the national law can not reach for a long time,and it also provides the cultural origin and historical reference for the construction of modern village rules and folk conventions.On the basis of inheriting the basic form and cultural connotation of traditional village rules and folk conventions,modern village rules and folk conventions are constantly innovated and advanced according to the development and changes of local society,forming new village rules and folk conventions with Chinese characteristics.Modern village rules and regulations embody the spirit of democracy,rule of law and autonomy,and take the form of rural autonomous organizations,the self-discipline system of villagers is aimed at speeding up the construction of the rule of law,perfecting the construction of the rule of virtue and promoting the construction of villagers’ autonomy.In Rural Governance,village rules and regulations effectively make up for the lack of legal and moral provisions,and play an irreplaceable role in maintaining public order,mediating disputes,educating the villagers,optimizing the environment and so on.Therefore,the party and the country attach more and more importance to the positive role of village rules and regulations in rural governance.At present,some villages in China have realized the importance of the village rules and regulations,and explored the new way of the role of the village rules and regulations in the village governance,giving full play to the positive role of the village rules and regulations in the village governance.However,due to various problems,most of the village rules and regulations can not play their own role as norms,which has become a bottleneck to hinder villagers’ autonomy and good governance.Therefore,this paper discusses the problems existing in the village rules and regulations and the obstacles encountered in giving full play to the role of governing the village,so as to remove the bottlenecks that hinder the villagers’ autonomy and the good governance of the village,it is of great significance to promote village rules and conventions to play an active role in village governance,to enrich the rules of village governance,and to tamp the effect of village governance.Through the method of combining theory with demonstration,this paper discusses therelationship and function between village rules and civil conventions and village governance,the practical application of village rules and civil conventions in village governance,and the various obstacles faced by village rules and civil conventions in playing an active role,and put forward the relevant countermeasures.This paper consists of five parts,the specific content is as follows:the first part is the introduction.This part briefly introduces the background,significance and methods of this paper,and integrates and summarizes the research results on village rules and regulations and village governance at home and abroad.The second part is an overview of village governance and village rules and regulations.First,it briefly expounds the meaning of village governance and village rules and regulations;Second,through describing the theoretical basis and practical background of the functions of village rules and regulations on village governance,we can see that the village rules and regulations and the village governance influence and promote each other,that is,the practice of village governance affects the formation and development of village rules and conventions,and the effective application of village rules and conventions promotes good governance in villages,this paper expounds that village regulations and folk conventions have the functions of standardizing villagers behavior,guiding village customs,guaranteeing villagers autonomy and inheriting traditional culture,which are indispensable in the process of promoting the modernization of rural governance system.The third part is the practical exploration of the effect of village regulations and civil conventions on rural governance.First of all,it expounds the status of making village rules and regulations in Xinhua County County;Second,it expounds the application of village rules and regulations in the aspects of village security,village customs,Neighborhood Relations and environmental improvement;This paper expounds the achievements made by the county through the application of village regulations and folk conventions.Through the empirical study,further demonstrated that the village rules and regulations have the role of promoting good governance in rural areas.The fourth part is the analysis of the obstacles of the village rules and regulations in the rural governance.This part includes three aspects: First,the problems of the self-construction of the village rules and regulations,namely,the problems of the formulation,the content and the implementation;Second,the rural social environment has a profound change,which makes the formation and function of the village rules and regulations gradually dissolve;Third,the township government’s excessive interference in the villagers’ self-government seriously restricts the positive effect of the villagers’ rules and regulations.These obstacles provide the basis for the further perfection and development of village regulations and folk conventions.The fifth part is to promote the village rules and regulations in rural governance to further play the role of countermeasures.Based on the above analysis,from the three aspects of the self-operating mechanism,the rural social governance environment,the relationship between the villagers’ autonomy and the township administration,this paper puts forward some countermeasures to promote the further function of the villagers’ rules and conventions in the rural governance.
