Exploring The Legalization Of Grass-roots Social Governance ——Taking Grid Management As The Analysis Object

The existing system of social management at the primary level as the urban grass-roots organization unit replacement,the cancellation of the rural agricultural tax and the promotion of the construction of the rule of law emerged intensified grass-roots management tasks,such as social governance to participate in a series of problems such as main body of a single,abstract generalization,governance,powers of governance matters up down,governance responsibility management dilemma.Grid management,as a new social management system,can effectively make up for the shortcomings and loopholes of the existing management.Based on the comprehensive analysis of the current situation,the existing grid management mode has typical mechanisms such as government-led top-level design and platform operation,party-government embedded organizational leadership and prominent technical governance attributes.But from the perspective of law,it is found that there are a series of problems,such as tension with grass-roots autonomy,fuzzy legal positioning,and legal risks brought by advanced technology.In view of these problems,in order to fully provide legal guarantee for the normal operation of the system,prevent and dissolve social risks in the new era,and guarantee grassroots democracy and autonomy,it is necessary to combine the grid management system with the construction of a law-based society under the background of promoting the law-based governance of grassroots society.Multiple measures should be taken simultaneously and joint efforts should be made.Improve laws and regulations of grid management setting and operation through scientific and democratic legislation;At the law enforcement level,by changing the law enforcement thinking,entrusting law enforcement power,setting up legal access list to ensure that grid management in the track of the rule of law to implement the overall requirements of strict law enforcement;In the aspect of the construction of legal thinking,it is necessary to comprehensively construct the legal thinking of multiple subjects including grid members,the masses,the government and so on,and explore the path of legal participation of social organizations.Only by integrating the above can we effectively regulate the establishment and follow-up operation of grid management system and platform,rectify the negative effects caused by congenital reasons such as the superiority of technological platform and the dominance of administrative power from the root,and ensure the orderly operation of the system within the rule of law track.
