Nature Of Organization,Conditions And Law-Abiding Of Organization

Advocating law-abiding is an important branch of the construction of a society ruled by law.The state pays close attention to the organization ’s actions in the process of implementing legal norms.However,due to the lack of human,financial and material resources,the government only carries out special law enforcement activities in a few key areas,the focus of people ’s livelihood,so as to urge the organization to abide by the law,such as the protection of personal information of Internet enterprises,the responsibility of ecological environment protection in manufacturing industry,and the safety of food and drug enterprises.The study of law-abiding can be summarized into two directions : the extension of western classical law-abiding theory and the hot issue of law-abiding research under policy guidance.From the single perspective of law-abiding reasons,cost considerations,law enforcement resources,law popularization education and the single scene of ecological environment protection and personal information protection,the analysis of the choice of organizational law-abiding behavior is slightly thin.This paper attempts to analyze why the bridge between legal texts and legal implementation is disconnected and how to repair it from the perspective of organization.In recent years,some studies have paid attention to the dilemma faced by the protection of the rights and interests of sanitation cleaning workers,especially that the rights and interests of industrial injury,medical treatment and pension have not been effectively implemented by sanitation enterprises.The reason can be traced back to the fact that sanitation enterprises have failed to apply for social insurance for sanitation cleaning workers in strict accordance with the laws and regulations of the social security series.In practice,the number of social insurance dispute cases and the data of social insurance premium compensation published by the labor security supervision agencies are very large.There are also many irregularities when enterprises apply for social insurance for employees,such as making employees promise to abandon social insurance and replacing social insurance with cash payment.The above research ignores the influence of the reform of sanitation enterprises on the choice of law-abiding behavior,and changes from the administrative department of sanitation to sanitation enterprises.The change of organizational nature has brought adverse effects on the choice of law-abiding behavior.The reform of sanitation enterprises is an attempt by the government to inject social capital into the sanitation industry to solve the financial pressure of the government.However,the reform increases the financial pressure of sanitation enterprises,and often saves human costs by not paying employees social insurance and other illegal acts.The supporting policies of sanitation marketization reform have not been established or yet to be improved.The protection of social security rights and interests of sanitation workers is in an isolated situation,which is one of the reasons for the frequent occurrence of social insurance payment chaos in sanitation enterprises.This paper first introduces the social insurance payment of M property management enterprises against the background of the current situation of social insurance payment in the sanitation industry.Secondly,it sorts out several factors that affect enterprises ’ non-compliance with social insurance laws : economic benefits of enterprises,law enforcement efforts of law enforcement departments,industry characteristics,nature and scale of enterprises,and education level of labor force.Finally,the relationship between the nature of the organization,organizational environment,law-abiding conditions are analyzed.It is considered that the change of the nature of the organization leads to the transformation of the environment faced by the organization,including the transformation of the technical environment and the transformation of the institutional environment.Therefore,the objective conditions of organizational law-abiding and the awareness of law-abiding of relevant personnel will also change accordingly.Compared with the behavior of social insurance payment before and after the reform of sanitation enterprises,this paper comprehensively analyzes the reasons for the change of behavior,and puts forward feasible countermeasures and suggestions.It can build a more smooth channel between the legal implementation and the legal text,bridge the gap between the text and the implementation;it can also reduce the burden of law enforcement for administrative organs and save human,financial and material resources.
