Researches On The System Construction Of Managing Universities By Law In China

Researches on the system construction of managing the universities by law is not only extending and expressing the management of universities by law, but also strengthening interior management and expressing the necessity of exerting autonomy. It can be categorized into two conceptions according to the main body and criterion: exterior system and interior system. The exterior system emphasizes the legal documentations that relative national departments or ministries establish for educational administrations. The interior system indicated by law for the university administration or management includes very important structure in the universities that provides much depth to the system of construction and management of universities by law. As a kind of unofficial leader, universities take on more of an independent jurisdiction, the most important of which is establishing the power of the interior system. Well established interior systems make university management flexible and efficient.In adoption of case and literature method, this paper analyzes the status of the system of management for universities by law. It comes out some problems and seeks for four principles: uniform validity and rationality; uniform science and efficiency; uniform stability and agility; uniform system and integrity. At last, it provides feasible advice to the question.This paper brings about some problems about managing the universities by law: the conflictions between rationality and validity; the conflictions between school regulations and basic laws; an unambiguous system; supervisory roles with limited power to influence the universities. It analyses: existing mistakes about managing the universities by law; a lack of power to influence our own laws. For constructing the system of university management, the university by law, the author indicates the four principles mentioned above: uniform validity and rationality; uniform science and efficiency; uniform stability and agility; uniform system and integrity. You can achieve these principles by adding depth to the structure of managing universities by law: strengthening the university's rule of law and the ability to be conscious about your rights; check the system often to ensure that it is rational; compose the supervisory role to guarantee that it is an appropriate system; secure an administrative course that would allow our universities to strive toward a perfect system.
