Research On Low-rent Housing Legal System

Housing is a basic necessities to everyone's life, which has general attributes of goods and social security attributes as well. It has been widely considered to be citizens' basic human rights that everyone should enjoy adequate houses. In order to implement social security functions in the housing sector, government should offer low-rent houses to solve the housing problems of low-income families. In 2007, "The opinions about resolving housing difficulties on urban low-income families by State Council" requests to speed up the establishment of low-rent housing system, and to focus on solving housing difficulties of urban low-income families by multi ways especially. It is already clear that the new framework of China's housing security system in the future: a government-led, multi-channel security system focusing on low-rent housing.Low-rent housing legal system, which is about relevant laws that formulated and implemented by government when market mechanism can not work on housing problems of low-income families and plays an active role in resolving housing problems of low-income families. It ensures social equity and stability. Some foreign developed countries have a very early attempt to housing security's legislation, resolving the housing problems of low-income families by implementation of special laws, although the intervention differs in protection modes and methods, the development trajectories of these countries have many similarities, from which we can learn useful experience.In practice, there are many issues in China's low-rent housing legal system, such as lower-level laws, lack of housing support functions, lack of security funds and house sources of housing and supporting mechanism is not sound, and so on. This article begins from the concept of low-rent housing system, characteristics, roles starting as well as theory basis of the establishment on low-rent housing legal system. Finally, from foreign countries' experience in the housing security legal systems and China's actual conditions of low-rent housing law system, this article make a precise research on the construction and improvement of the low-rent legal system.
