A Study On Community Correction Of Juvenile Delinquents In Lingwu City

Community correction is a way of criminal penalty that manage and reform those offenders who meets the standards of law in community rather than in prison, and eventually those offenders could be rehabilitated and integrated into society. As juvenile offenders are more special than adult offenders in physiological characteristic, mental characteristic and other features, the criminal penalty for them should also be different from adult offenders. Community correction can be a good way of punishment for juvenile offenders who meets the standards of law, for this kind of criminal penalty could not only strengthen their sense of society responsibility, bring them back to normal life, but also can reduce the recidivism rate of juvenile offenders. Community correction have been widely practiced in our nation for a dozen years, and implementing for five years in Lingwu city. During this time, although we accumulated valuable experience and made huge progress both in theory and practice, there are still some disadvantages needs to be improved. For example, we have no community correction law to obey by now, not to mention to legislate a particular code of community correction for juvenile offenders. Many explorations and attempts were taken by regional governments in different places in order to find the right way of develop community correction, but the management of community correction in nowadays were still far from satisfactory. According to this situation, This paper took Lingwu city (located in Ningxia Hui Autonomous Region) for an example, attempt to analysis the management situation of juvenile offenders community correction in there from the perspective of social management innovation. The author gains the first-hand information by investigate and visit local community correction bureau, take juvenile offender individual case study and many other ways, trys to improve the management situation of juvenile offenders community correction in Lingwu city by coordinating social forces(such as volunteers, citizens, NGOs and other social groups), Using the social management theory and method, etc. Hope this paper could provide some references for the management situation of community correction for juvenile offenders in our nation.This thesis have five chapters and each chapter was summarized as follows:In chapter one, the author clarifies the research background and significance of this paper, explains the research framework and methods of this paper by summarize the research development of China and abord.Chapter two explains the basic definition of community correction, then extended the definition of community correction for juvenile offenders from this basis. After that, the definition of social management innovation was elaborated.Chapter three analysis the necessity of juvenile offenders community correction from three perspectives:the management characteristics and present situation of juvenile offenders community correction, the effectiveness and efficiency of juvenile offenders community correction, and the significance of social management innovation to the juvenile offenders community correction.Chapter four introduce the research of present situation of juvenile offenders community correction in Lingwu city, explores the deficiency of juvenile offenders community correction, such as the lack of experience of local community correction administrators, the lack of management facilities and programs, the difficulty to achieve the effective management for community correction for juvenile offenders.Aimed at the weaknesses of juvenile offenders community correction in Lingwu city showed in chapter four, chapter five propose the comments and suggestions to solve these problems:In one hand, establish coordination system between different government departments, improve the ability of juvenile offenders community correction staffs. On the other hand, government purchases services program from professional social groups, build a joint management mechanism that include volunteers, citizens, NGOs and other social groups. In addition, we should refine the community correction program for juvenile offenders, especially focusing on community correction programs such as juvenile offenders community service, prohibition order, electronic surveillance device and so on. Lastly, for the sake of manage the juvenile offenders community correction successfully, we should establish funds guarantee mechanism, pretrial investigation mechanism for juvenile offenders and other supporting mechanisms.
