The Promulgation and execution of"The People's Republic of China Civil Servants Act"(below abbreviate as Civil Servants Act) signifies the improvements of the law of civil servants management, which also provides legal foundation for future civil servant management. As for such serious problems as the low administrative efficiency and corruption, the author, on the basis of scientific theory and the actual situation, studies the restraint and encouragement mechanism of civil servants and then proceeds to put forward some audacious assumptions.The article regards the civil servants as the object for study. Through summarizing the previous achievements, studying the theory of requirement and the theory of human nature presumption,the author presumes the nature of civil servants, makes clear the theoretical basis of civil servants restraint and encouragement mechanism and looks for its defects and analyzes its reason of existence. Then, through the study of restraint and encouragement of civil servants law and the analysis of its current situation, the article applies comparative study method for comparing domestic with overseas civil servants management systems and civil servants status, introduces and uses for reference domestic and overseas advanced experience. Moreover, the article also studies and analyzes the social phenomenon and the problems concerned in the process of the operation of civil servants restraint and encouragement mechanism so as to put forward some suggestions about the principle, the system set-up and the improvements of civil servants restraint and encouragement mechanism.
