The Path Of Rule Of Law Published By Government Archives Information

The government information publicity system was born in Sweden in the last century,and quickly became a worldwide trend,which is the best way to protect the right to know of citizens.As a form of government information in different life cycle stages,archives are an integral part of government information.However,China's"Government Information Disclosure Ordinance" and the "Archives Law" set out a completely different set of two open system,the public's non current documents of the right to know is limited to a lower form.Therefore,it is necessary for us to study the coordination between them and improve the provisions of the archives law so as to adapt to the public needs of the information disclosure environment.This article from the origin of legislative regulations on open government information and archives law began to describe,to improve the study of government information disclosure system from the perspective of open archives,from the protection of citizens' right to the point of view,focus on the analysis of the relationship between the two systems,although China has no legal provisions that citizens the right to know as a substantive right there but the system construction is still the right to carry out construction.There are six parts in this paper,including two chapters:introduction and conclusion.The first part mainly defines and distinguishes the concepts related to the publicity of government archives and their relations,and finds out their differences and relations.The second part from the perspective of comparative law,from the history of the two systems to speak up,to analyze the rights of citizens to government archives information,and learn from the system in USA government information public domain,to provide reference for the improvement of our country.The third part is the problems of the two systems in the process of government information publicity,and demonstrates the shortcomings of our country at present through detailed cases and data.In the fourth part,on the basis of summing up the foregoing,this paper makes a preliminary study on the rule of law of the government archives information publicity in our country,and puts forward some useful solutions to the existing problems.
