Research On The Identity Security System For Civil Servants In China

The development of civil servant system significantly represents the national governance system and modernization of governance capacity.Along with providing talented and reliable teams of civil servants and ensuring correct implementation of the national fundamental policy,laws and regulations,modern civil servant system needs to fully secure the fundamental rights of civil servants so as to guarantee the team stability of civil servants and their work continuity.Among the fundamental rights of civil servants,the right of identity security is of considerable significance as it involves key issues such as the retention of civil servants' identity and their promotion or demotion,and it is also a basic premise for civil servants to secure other rights.As a special group,civil servants themselves embrace multiple identities including citizen identity,job identity,political identity,legal identity,etc,and the differences of rights and obligations among various identities mainly cause the identity conflicts of civil servants and also the divergence of theoretical research and design of civil servant system.According to foreign countries,western countries represented by the United Kingdom attach great importance to identity security of civil servants.Influenced by essential guiding principles of "political neutrality" and "the separation of the two officials," they form identity security system of civil servants based on the identity classification of administrative officials and affairs officials so that a series of problems such as team instability of civil servants and work discontinuity caused by the replacement of ruling party can be avoided at utmost,thus further providing a sound and efficient system environment for identity security of civil servants.At present,the role and position of the government in the development of economics,politics,society and culture have remarkably changed and simultaneously,civil servant system keeps improving accompanied with the changing national governance.The domestic identity security system of civil servants have received extensive attention and triggered active discussion in the theoretical circle and practical circle.Nevertheless,due to weak foundation of research on identity security system of civil servants in China,complete theoretical systems have not yet established,thus creating difficulty in efficiently guiding current systems as well as restricting the development of identity security system of civil servants in China to some extent.Therefore,the author chooses identity security system of civil servants as objectives,finds out the common law of identity security of civil servants under different political systems through the comparison of the theoretical research and system design of identity security system of civil servants among western countries with relatively mature legal systems,and provides a resultant reference for the development of identity security system of civil servants in China.The paper is divided into four parts in total.The first part is introduction.The introduction mainly illustrates the significance of topic selection,research status,research methods,key and difficult points of research and its innovation.The second part is the comparison of western identity security systems of civil servants.In this part,some western countries with typical and representative civil servant systems are mainly chosen,their differences of identity security systems of civil servants under essential guiding principles of"political neutrality" and "the separation of politics and executive" are analyzed and compared,and efficient laws underlying identity security systems of civil servants are summarized and extracted.The third part is the operation of identity security systems of civil servants in China and its reflection.In this part,some relatively classical infringement cases on identity security of civil servants in China are mostly analyzed,the existing source problems in our identity security system of civil servants are recognized,and the direction for the following system development is further provided.The fourth part is strategies to develop identity security system of civil servants in China.In this part,specific ways to solve existing problems in our identity security system of civil servants are proposed in combination with results gained from analysis and research.
