The Research On The Legal Regulation Of Administrative Examination And Approval Procedures For Construction Projects

In the context of the transition of government functions,in order to further improve the efficiency of the administrative examination and approval of the administrative departments and provide better administrative services to those who are relative to the administration,various localities have carried out reforms in varying degrees on the administrative examination and approval procedures for construction projects.However,the administrative approval procedures for construction projects after the reform are still widespread,highlighting the lack of participation of stakeholders,the unclear approval and the lack of normative,self-examination and approval of internal scrutiny and other issues of legitimacy and legitimacy.This article starts with the process of administrative examination and approval of construction projects,summarizes the current administrative approval procedures for construction projects based on whether there is relative participation or not,and divides them into external procedures and internal procedures.At the same time,"limited government "theory,government market theory and" government service "theory to further analyze the above problems,and try to put forward a path of legal regulation.The solution proposed in this article is divided into two parts,namely,the legal regulation of the external procedure and the legal regulation of the internal procedure.The legal regulation of the external procedure includes the establishment of the consultation procedure,the diversification of the participants,the rationality of the approval period and the orderliness of the examination and approval.The legal regulation of internal procedures mainly includes two major points.First,the boundaries and methods of legal regulation include:legislative regulation,self-regulation by administrative agencies and judicial review.Second,the exploration of the path of legal regulation of internal procedure includes:perfecting the relevant legal norms of amending internal procedures,strengthening the self-regulation of administrative organs and exploring the judicial regulation of internal procedures.
