Research On Legal Issues Of Social Work Intervention In Community Correction

Community correction refers to a special way of execution of punishment compared with traditional imprisonment.Community correction is a unique way of executing penalty in China.On the one hand,community correction itself includes the severity of penalty in general.On the other hand,community correction also has the mitigation of social work.It is a kind of penalty which needs the help and supervision of all members of society under the regulation of public power.Since 2003,our country began to implement the pilot community correction.So far,the development of community correction has gone through 16 years in our country.However,there are still many problems in the theoretical and practical process of community correction in our country that need to be improved and solved urgently.The voice of social work intervention in community correction is also growing.By sorting out the relevant domestic and foreign literature on social work intervention in community correction,comparing the development status of social work intervention in community correction at home and abroad,this paper explores some hot topics that are concerned by the public,such as the stipulation and restriction of rights and obligations in the process of social work intervention in community correction,and the form of social workers' intervention in community correction.In the part of practical investigation,we mainly take Bengbu Bengshan District Judicial Bureau as the research object.Through actual visits and interviews,we collected some practical knowledge about social work and community correction,and then studied the relationship between community correction and social work.Through practical investigation,the author finds out the practical problems existing in the process of social work intervention in community correction,and then summarizes the relevant laws of social work intervention in community correction in Bengshan District,and puts forward the practical problems of social work intervention in community correction in our country at present: imperfect legal formulation of community correction;problems existing in cooperation with other institutions;lack of rights and obligations of social workers.Lack of legal provisions.On the basis of practical investigation,the following suggestions are discussed and put forward.Firstly,it discusses the imperfection of the relevant legal formulation of social work intervention in community correction and the imperfection of the supporting legal system of social work intervention in community correction;then it analyses the rights and obligations of social work intervention in community correction,and puts forward some suggestions on the path of social work intervention in community correction;finally,in order to ensure the integration of social workers and their community correctors.Legal rights and interests,put forward in the legislation to the way social workers exercise their rights,social workers should abide by relevant rules,social workers violate the consequences of legal provisions,social workers dereliction of duty and legal supervision to make clear legislative provisions.Figure 2;Table 1;Reference 41...
