Research On The Owners Committee In Urban Community Property Management

With the development of China's economy and society,especially the reform of the housing system since the reform and opening up,the owners' committee based on the division of ownership of buildings has been continuously developed and practiced in the field of residential property management in China.However,whether it is academic or practice,the flaws in this type of organization are different.Someone who calls it "the first voice of civil society in our country",while there are also someone believed that it may “detrimental to grassroots governance and community democracy”.This article which uses theories and perspectives of political science and public management through the observation and thinking of the owner committee of the R Community Property Management for 6 years,has found some interesting conclusions and put forward some policy recommendations for governance.In the practice of community owners participating in property management,there are at least four participants,three pairs of interactions and two principal-agent problems.The four participants are:1.Market buyers and property service recipients which represented by owners' residents;2.Market suppliers and property service providers which represented by property companies;3.Owners' organizations which is represented by the owners' committee and defenders of the rights and interests of the owners;4.Government organizations which is represented by neighborhood committees and street departments are supervisors,coordinators and potential trustees.The three pairs of interactions are:1.The interaction between the owners and the property company by management and being managed and complaint feedback;2.The inter-neighborhood interaction between the owners and the owners' committee by participation,communication,expression,decision making,execution,and feedback;3.The interaction including communication,game,collaboration,supervision and being supervised between the owners' committee and the property company.The two principal-agent problems are: How to regulate the exercise of the boundaries of power and the way of power restriction when the principal-agent relationship was created between the owners and the owners' committee by voting;How to encourage a property management company to implement and regulate the management rights of the community in practice when the principal-agent relationship was created by the owner's committee which represents the owners signs a contract with the property management company.This paper argues that for urban community owners' committees,democratic expression and decision-making,the establishment of internal and external institutional structures,and maintaining the organizational strength of the owners are the most important issues that plague the owners' committee.From the perspective of establishing internal and external institutional structures,the process of institutionalizing improvement of “conflict integration” may be its path,also can guarantee its organizational effectiveness and achieve governance effectiveness that centered on it.From the perspective of the maintenance of the owners' organizational strength,the interaction and game density between the neighbors may be the basis for the formation and deepening of trustworthiness,and also an important way to ensure organizational stability and organizational legitimacy.From the perspective of the democratic expression and decision-making of the owners represented by the owners' committee,how to coordinate internal and external relations,especially how to adhere to the Party's political leadership,while at the same time making independent decisions on some issues is its difficulty and pain point.From this point of view,the owners' committee may indeed be regarded as the "first voice of civil society" in China becaouse it is indeed possible to appear on some issues as a “partner” to negotiate with the government.Of course,in these cases,the actual performance of government officials may be inconsistent with the Party's leadership.Therefore this article believes that the owners' committee should adhere to the Party's philosophy,such as adhering to the theory and practice,unwavering,taking the facts as the yardstick,taking the people's livelihood as the bottom line,adhering to the mass line,constructing expression channels for the majority of the group,and seeking material welfare,spiritual wealth,and always adhere to the methods of criticism and self-criticism in practice,in order to avoid the individual in the organization or the behavior of organized "corruption" and "lazy politics".In this way,it is possible to achieve democratic expression and independent decision-making as much as possible while upholding the political leadership of the Party.In addition,the paper also finds that in the process of defending the rights of the owners,there will be a decline in the level of confrontation from the network to the entity,and a decline in the level of expression from direct deliberation to representative.From this,it is speculated that there may be a law: the more abstract and direct the space of discussion,the more energy it expresses because of its low external limits,while in the multimedia space(multiple senses distracted),due to the constraints increase,the probability of expression energy being transferred and dispersed increases,and the actual expression level becomes weaker.
