Inspired by the theory of Professor Shizhong Du Central China Normal University, I wrote this thesis based on my six years'practical experience of middle school in teaching and management. By Questionnaire Method, Interview Method Literature Review Method and so forth, I understood present situations of the disciplines, content and the implementation in junior middle school deeply. I have carried out some problems of the disciplines in formulation and implementation, and put forward as follows:(1) the non-standardization of the procedure in formulating the disciplines in junior middle school; the illegal basis of the disciplines; the ambiguous executive subject; the absence of teachers and students in the formulation; unconsciously modifying the disciplines according to the fact of education and management; no attention to the publicity to the teachers, students and parents after formulation.(2) The obsolescence, rigidity of the contents of school regulations; lack of humanism, operability, and timeliness, signal forms of punishment And they pay more attention to "endure" than "lead". They can't reflect new problems of the students in new things. Besides, they don't consider the features of student so that they don't initiate the parents.(3) They are rash and casual when they execute the school disciplines and regulations. Complement students to submit and fierce consciousness resistance of students coexist. Teachers don't manage students according to school disciplines and regulations. And corporal punishment and covert corporal punishment still exist.According to problems. The author came up with some solutions:(1) Education departments must clear the procedure and basis of making school disciplines and regulations; they should direct the important content of school disciplines and regulations. They should promote the supervisor to the verification and implement.(2) We should standardize school disciplines and regulations in procedure, establishing democratic ones. And we must fully transfer the teachers and the students to participate in the formulation of school disciplines and regulations.(3) The contents of primary middle school disciplines and regulations lack the feasibility and the effectiveness, and many of the articles simply prohibit something or strictly require students to do something so that it lets junior middle school teachers at the compulsory education stage be impossible to follow. So the situations make the teachers give up to bundle the students'misdeed, or manage the students by illegal violation of regulations. Thus the contradiction between the teachers and students seriously was intensified, the quantity of the "bad" student was expanded, and many serious social questions were caused. So we needs to learn experience from overseas countries, specially from US, South Korea, Japan, to formulate and use school disciplines and regulations in urgent. Then we unify the reality of education of our country to formulate the legal laws and regulations which are able to manage the students effectively and the students are glad to accept.(4) In many primary middle school disciplines and regulations, provisions are old. Great attention does not be paid to the connection between the real education and present situation, and they do not respond to many new questions in the current teaching practice, which caused the schools and the teachers at a loss facing many new questions among young people arisen in new time. Therefore, to formulate school disciplines and regulations suitably in middle school, we should pay great attention to keep pace with the times, set up the consciousness of innovation and strengthen the effectiveness of school disciplines and regulations during managing school affairs.(5) In primary middle school disciplines and school regulations, there are many provisions with "imperial authority consciousness":They even don't respect the laws of education, the characteristics of bodies and minds development of students'in this special age. That will surely causes some students to form either serious servile psychology or abnormal, which does not conducive the young people to develop perfect personality. Therefore, the formulation and the usage of the school disciplines and regulations should be fully considered with the laws of education, and should care more about characteristics of young people's body and mind within this special education time.(6) All of these cause the teachers and the students to express their disregards to school disciplines and regulations, and encourage the teachers and student's illegal behavior. Therefore, the use of the school disciplines and regulations need to be standardized, which will create a new environment to educate people by system.
