In the People's Republic of China, the responsibilities of national civil servants are to handle public affairs and represent the power of nation. But for the special situation of our country, civil servants are composed of people not only from government but from other units as well. Thus, the Chinese people are always obscure in the confines of civil servants. Recent years, the market economy has been founded associated with the development of our society. Enhancing the Construction of Government Official Group is needed to serve economic development,reform and opening up. Identifying the confines of civil servants will not only help whom to Promote Administration by Law, strengthen Legal consciousness, but also protect their legal right. Thisthesis does some instructive discuss on the scope of civil servants.The first part of this thesis introduces the practice and experience of identifying the. confines of civil servants in some major countries of the world. Especially focus on analysis of classification methods in England, America, and France. In addition, the scopes of civil servants in Hongkong, Macao and Taiwan were introduced.To Look into the Future Depends on the Mirror of History. The second part of this thesis reviewed the Reform process of carders personnel system, and the establishment and developing of the conception of the civil servant institution in our country. The scope of civil servants in current China's Civil Servant Law was investigated through reviewing whose changes in past years.In the third part, the current situation of civil servants in our country was introduced. The characters of the scope of civil servants in China were summarized through comparative research on public servant system between Chinese and western. First, characters, such as non political neutral of Chinese public servants, non-marking off political official and clerical official, sticking to the principle of the Party's management on talents and insist on serving the people, are different from the western civil official's system. Second, compared with traditional cadre personnel system, the new system defines the scope of civil servants more exactly. Civil Servant Classification System is being perfected. Third, the Chinese civil servant system has unique guiding principles.The new Civil Servant Law is established on the basis of the practical experiences for years, which extends the previous Temporary Regulation of Civil Servants with Inheritance. It has lasted for 5 year and been revised for more than 20 times. In the process of legislation, experts, government and society gave their attitudes and valuable advices from their points of view, including the definition of the scope civil servants. The author's points were proposed in the last section.Firstly, generalized definition leads to overstaffed construction of civil servants associated with lower working efficiency;secondly, incorporating the administration staff of the communist party and multi-party into the scope of civil servants will lead to difficulties in reasonable management; thirdly, incorporating judges and procurator into the scope of civil servants will result in judicial conflict; fourthly, incorporating teachers in public schools and doctors in public hospitals into the scope of civil servants will be beneficial to the development of education and medical reform.The first twenty years in this century are the -important strategic opportunity period for our country's economic and social development. The following years is the critical period for overall construction of a well-off society. Establishing scientific and seasonable scope of civil servants will remarkably impress-deepen the reform of the personnel system of. cadres, and promote the management of civil servants scientification, democratization, and systematism.
