The Research On The Issues Of The Legalization Construction On Intelligence Collection In Public Security Department

The intelligence work is more and more widely in public security department since the "intelligence-led policing" strategy has been enforced.But as a result of the legal regulation on the intelligence work in public security department is not complete,it sprang out many problems,such as the ways are unblocked,the collection objects are incoordination,the invasion of citizens' privacy and the judicial effect of secret collection,etc.Therefore,we must focus on solving these problems in the process of legalization on intelligence collection in public security,and restricting the intelligence collection in public security from the legislation,law enforcement,judicial and observance of the law,so then promoting the benign development of the intelligence collection in public security and keeping it on the rule of law.This article can be divided into four parts to discuss from the view of legalization on intelligence collection in public security department through the literature,comparative and empirical research methods.Firstly,explaining connotation of the rule of law in intelligence collection in public security department.Secondly,combining of the intelligence collection in public security department to analyze the existing problems and explain the necessity of the legalization on it.Thirdly,summing up the experience of the rule of law in Chinese public security of intelligence collection,contrast with the British and American intelligence work.Lastly,raising the principles of the intelligence collection in public security department and the suggestion of the path,the emphases on the legalization of the intelligence collection in public security department,so as to ensure maximizing the intelligence collection and the protection of the legitimate rights of citizens'.
