As an inalienable part of the People's Republic of China,Taiwan's civil service disciplinary system originated in the mainland.From the constant exploration in the previous period to the establishment of the system,especially the continuous development and innovation in recent decades,the civil service disciplinary system in Taiwan has become more mature.The principle of fairness,openness,and independence embodied in the system design has laid the foundation of the disciplinary system for maintaining and regulating,educating and punishing.At present,the Taiwan region has made many achievements in the construction of discipline subject,the disciplinary of reasons and forms,mechanisms and procedures for punishment,such as,the well-established punishment system,the varied forms of punishment,the high-independent institutions and the rigorous procedures of disciplinary.However,it is undeniable that due to the defect in design and application of the five-power politics in Taiwan and the disconnection between the reform and the institutional reality,many problems have appeared in the civil service disciplinary process in Taiwan since its establishment.In practice,the independence of civil servants was not independent,and controlled by governors.And it is very prominent to the problem of selective punishment and excessive mild punishment.Through continuous improvement and innovation,the punishment system of civil servants in Taiwan has basically got rid of the above shortcomings,but new problems have arisen.Due to the combination of administrative punishment and civil service disciplinary action,it often leads to administrative punishments to evade punishment of civil servants,to lead the power game between the disciplinary subject and other organs' powers.What's more,there are fewer members of the disciplinary committee to meet actual needs.These problems has restricted the whole civil servant punishment system to play its role.Although there are many problems in the civil service punishment system in the Taiwan region,regarding the completeness of the system,it has made many progresses in legal design,institution building,and procedures and forms of discipline,which is useful thoughts for us.
