Research On Emergency Guarantee Function Of Economic Law Under Unconventional State

Since the 20 th century,unconventional states such as financial crisis and public health emergencies have occurred frequently.In this state,the economy and society are bound to suffer.As an unconventional function of economic law,the emergency protection function can protect the stable operation of the economy,protect people's livelihood and maintain the order of the market and society through comprehensive and effective macro-control measures and precise market regulation measures when the unconventional state comes.The emergency protection function has been in all stages of economic law development,and risk society theory,disaster economics theory,responsive law theory and social governance theory have provided the theoretical basis for its rationality and necessity.However,there are problems of insufficient effectiveness of state intervention,lack of effectiveness of economic law emergency protection system,and lack of fair consideration of response measures when economic law emergency protection function is applied under unconventional conditions in China.In this regard,it is advisable to set up a correct and reasonable intervention concept,establish a systematic and perfect economic law emergency protection system and implement a scientific and efficient economic law emergency protection mechanism,so that the economic law emergency protection function can be more fully and effectively played when the unconventional situation comes.
