At present, the rapid development of science and technology has more and more influence on economic, political, military, culture and other aspects of the society. According to the reality of the situations and the variety problems of science and technology, the state has made lots of complicated policy of science and technology in order to make effective adjustment to social relations of science and technology. The policy has made remarkable achievements. But with the great development of the innovative and high technology and the great changes in society, the shortcomings of the pattern of "rule of man" show up.Meanwhile, the target is unable to complete and the actual effect can’t match with the original plan. How to guarantee the established policy to gain the stated result is a problem to be solved urgently.In view of this situation, according to the relationship of the policy and legal,this thesis discusses the possibility of the transformation of scientific and technological policy and the law. On the basis of the development history and present situation of science and technology policy, the paper analyzes the failure reasons of the present situation of the country’s science and technology policy. Considering the current trend of social development, the trend of development of the science and technology and its policy, the policy legalization is quite necessary. Based on combing the relatively mature experience of other countries, the paper proposes the system construction of our country’s science and technology policy legalization, reiterates the main viewpoints of this article, suggests legalize the mature science and technology policy,guarantees the development of science and technology by the corporate means of the policy and law in the conclusion section of the paper.
